Terms of Service
These terms apply when you engage Elevate Digitals to design, build, or maintain a website. By paying a deposit you accept them.
1. What we agree on first
Before any money changes hands we agree in writing on the scope of work, the package or custom quote, and the price. That written scope, together with these terms, is our agreement. Anything outside the agreed scope is new work and is quoted separately.
2. The free first concept
We design your homepage concept before you pay anything. If you decide not to proceed after seeing it, you owe nothing and the concept remains our property. You may not use, adapt, or pass the unpaid concept to another designer or developer.
3. Payment
- Once you approve the concept, a 50% deposit is payable to begin the build.
- The remaining 50% is payable on completion, before the site goes live on your domain.
- Prices are quoted in South African Rand (ZAR) and exclude VAT.
- Monthly retainers are billed in advance and may be cancelled with 30 days' notice.
4. What we need from you
We need your content — text, images, logo, and access to your domain — to build the site. If we are waiting on you for more than 30 days, we may pause the project and reschedule it against other work. Long delays can affect the timeline and, where the pause is substantial, the price.
5. Timelines
Estimated turnaround for a standard package is two weeks from the date we receive your deposit and your content. Timelines are estimates, not guarantees, and depend on how quickly you review and respond at each stage.
6. Revisions
Each package includes a set number of revision rounds, listed on the package. A revision round means one consolidated set of changes. Additional rounds, or changes that alter the agreed scope, are billed at our hourly rate, quoted before we start.
7. Who owns what
- On final payment, you own the website files, the content you supplied, and your domain.
- You are responsible for holding the rights to any content you give us to publish.
- We retain ownership of our underlying tools, code libraries, and techniques, which we reuse across projects.
- We may show the finished site in our portfolio unless you ask us in writing not to.
8. Hosting and domains
Unless we agree otherwise, your domain is registered in your name and you keep control of it. Hosting is included in retainer plans; without a retainer you are responsible for your own hosting costs and renewals after launch. We will tell you what these cost before launch.
9. Support
We respond to support requests within 24 hours on weekdays. Retainer clients get priority. We are a small operation and do not offer around-the-clock cover.
10. Cancellation
Either of us may end the project in writing. What happens to money already paid is set out in our Refund Policy. On cancellation you receive the work completed to that point, provided the work completed has been paid for.
11. Liability
We build and test carefully, but we cannot guarantee a website will be free of every defect, that it will achieve any particular search ranking, or that it will produce any particular number of enquiries or sales. Our liability is limited to the amount you have paid us for the work in question. Nothing here limits liability that cannot be limited in law.
12. Governing law
These terms are governed by the laws of the Republic of South Africa. Your rights under the Consumer Protection Act and the Electronic Communications and Transactions Act are not affected.
